Senator Estes asks TCEQ to hold a public hearing on asphalt plant permit

AUSTIN - Senator Craig Estes (R-Wichita Falls) sent two written notifications to the executive director of the Texas Commission on Environmental Quality requesting a public hearing and calling for a careful review of the Rushing Paving asphalt plant permit application for near Pottsboro.

"My office has been in close contact with several constituents concerned about the public health and safety issues for a proposed asphalt plant to be located near Pottsboro," said Estes. "In response to these constituent concerns, I have made an official request for a public hearing to take public testimony on possible health and safety concerns, and requested a careful review of the permit application."

In a letter dated February 28 to the TCEQ, Estes requested a careful review of the Rushing Paving standard air permit application to ensure full compliance with standard permit requirements in meeting all applicable state and federal requirements for protection of public health, including any standards for concentrations of contaminants, and if applicable, consideration of impact on surrounding area.

"There seems to be conflicting information coming from the TCEQ as to whether a public hearing can be called to review this permit application," said Estes. "Therefore, to cut through this conflict of information I submitted a formal written request for a hearing."

In a letter dated March 5 to the TCEQ, Estes requested a public hearing to take public testimony on possible health and safety concerns, and to consider this information in TCEQ deliberations on final issuance on the Rushing Paving standard air permit application.

"The residents in and around Pottsboro are concerned about the impact this facility will have on their public health and safety. It is incumbent upon the TCEQ to properly address these concerns and to fully enforce the rules and regulations applying to these standard air permits," added Estes.
