Ellis legislation to be reviewed by Senate Business & Commerce, Criminal Justice Committees
(AUSTIN)—Legislation by Senator Rodney Ellis (D-Houston) to require prior approval of the of insurance rate increases by the Texas Insurance Commissioner, and legislation to require access to post-conviction DNA testing will be heard by the Senate Business and Commerce and Criminal Justice committees tomorrow, March 22, 2011.
SB 740 would require any property and casualty policy rate changes from insurance companies to be approved by the insurance commissioner prior to implementation. Specifically, it would allow the insurance commissioner to deny approval of rates that are found to be excessive, inadequate, or unfairly discriminatory.
SB 122, a Tim Cole Advisory Panel recommendation, would clarify Texas' post-conviction DNA statute to address issues that have arisen in recent court decisions and an exoneration in Houston.
